    • The use of Services in ways other than explicitly stated by BSG Aesthetics personnel or stated in user manuals

Intellectual Property All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of BSG Aesthetics or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or display any content from our website without our prior written permission.   
  2. Disclaimer of Warranties THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, UNLESS AGREED UPON IN A PURCHASING AGREEMENT. BSG AESTHETICS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WARRANTIES EXPRESSLY WRITTEN.

Limitation of Liability IN NO EVENT SHALL BSG AESTHETICS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICES.   
  4. Misuse of Equipment BSG Aesthetics is not responsible for any damages or injuries caused by the misuse of equipment provided. Customers are responsible for following all safety instructions and guidelines provided with the equipment. Any misuse of equipment, including but not limited to failure to follow safety instructions or operating the equipment in a manner contrary to its intended use, may result in personal injury, property damage, or other adverse consequences.
  5. Force Majeure BSG Aesthetics shall not be liable for any delay or failure to perform its obligations under these Terms of Service due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.
  6. Indemnification You agree to indemnify and hold BSG Aesthetics harmless from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms of Service.
  1. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of Ventura County, California. Any dispute arising out of or in connection with these Terms of Service shall be submitted to the exclusive jurisdiction of the courts of Ventura County, California.
